Examples of Common Commercial Insurance

The most common types of commercial insurance are property, liability and workers' compensation. In general, property insurance covers damages to your business property; liability insurance covers damages to third parties; and workers' compensation insurance covers on-the-job injuries to your employees. Depending on your business, you may want additional specialized coverages.

Examples of Failing to Have Proper Commercial Insurance

A family owned business with 15 employees, had a 1 million dollar general liability policy with a 2 million dollar umbrella in force. The owners believed they had proper liability coverage. They promoted a long term employee, a Hispanic woman, to a supervisory position. After a short period of time they determined that she was not fulfilling her role as a supervisor. Rather than demoting her, they promoted another employee to Supervisor and split the duties. The Hispanic woman was insulted by this and claimed discrimination. The owners went to their insurance agent and learned that discrimination was not covered under General Liability. Discrimination would fall under Employment Practices Liability Insurance (EPLI). Due to this gap in coverage the family had to borrow $100,000 for legal fees and it never even made it to court!

A carpenter contractor doing business as a sole proprietor did not have Workers Compensation coverage in force as he had no employees and felt he didn’t need it. He hired a worker just for the day. That worker fell off the first step of a ladder and broke his wrist. The contractor thought the medical expense coverage on his General Liability policy would cover this. It would not as that coverage is only for “on premises” and does not include employees or independent contractor without insurance. The contractor spent $20,000 on medical bills, legal fees and lost wages.

A business owner sent one of his employees to run an errand in their personal vehicle. That employee was in an accident with another vehicle. Both parties were injured. Workers Compensation covered the employee’s medical expense. Although the employees’ personal auto coverage responded first to this claim, the other party sued the business owner as well. Hired and Non-Owned Auto coverage would have protected the business owner. He elected not to take this coverage. It is currently in litigation.

An investor bought a property he planned to rehab and then sell. When the home was completed it was moved from a Builders Risk to a Business Owners Policy. When complete, a pipe burst and caused $150,000 of damage to the home. The claim was denied because the property had been vacant for more that 60 days. It should have been insured on a vacant dwelling policy. The contractor had to tear down the home as it was inhabitable and not repairable. He lost $300,000.

A retail store was forced out of business. It was located in a strip mall next to a large grocery store chain. The grocery store had a fire and was closed for 6 months. As a result the traffic through the strip mall was dramatically reduced. Almost immediately sales at the retail store decreased by 50%. If they had had Business Income coverage from dependent properties their loss of income could have been covered from their insurance carrier.
